I had the opportunity to work with a stunning model at Burning Man. You can see some of the photos in my profile. We agreed that if I ever sold any that I'd give her a cut of the profit. I haven't sold any but will honor that. However, in order to sell these photos I need a model release from her. She wants her share of the profit as part of the contract. I have no issue with this. But I can not find any stock model release forms on-line that have compensation written into them.
Does anyone know where I can get one? Or would the compensation be in a separate contact?

Wed, January 28, 2009 - 10:04 AMI am by no means an expert but, in my experience a model release will not have that clause written in because generally we pay models for modeling not for the sale of your copyrighted image. What the two of you are trying to do might be better accomplished with a separate agreement between the two of you written or otherwise. Making note of the other contract on the model release might make everyone feel better but it seems arranging a flat fee for the modeling services would be reasonable exchange for signing the release.
Unless you sell the image it is my understanding that you do not need a model release, there are other stipulations, such as if the photo was taken at a public event, if it is for education use etc... in those cases you do not always need a model release.

But she said that if I profited from this gift that I should compensate her. That's how it came about. I don't know the enough of the legalese to word the contract to reflect that.

Wed, January 28, 2009 - 10:41 AMI've used model releases in the past that have compensation lines in them. The model release itself is just a legal release of rights to use her image.So there are two ways I'd approach this. One, I'd modify a model release, leaving all the other language intact, but adding a line where you acknowledge the percentage you'll give her for any sales. And I'd include in this a standard boilerplate contract of business, setting forth the amounts you both receive from any sales.
The second way, and the way I would much prefer if I were doing this, is to just staple together a standard model release, leaving in intact, and the second page would be your business contract. In the end, it boils down to trust, she has to trust you to actually tell her if you sell any prints. This way she can read and sign both at the same time, and the legal language isn't tampered with. Models can and do include language in releases as to what way those pics are used, like excluding electronic use. Check your local state laws, but at least here in Colorado, a model can write into the contract specific options, such as no use on net, or restrict sales.
Feral, you might want to think hard about this type of promise in the future. A model can change her mind, want more of a cut, anything. If you have a signed model release at the time of the shoot, you can use those images, and still, out of your own appreciation of their talent, give them some of the money. This is the way I work, I give them a copy of any image, with full usage rights, and get a signed release. And I usually ask the model before I use the image. It depends on your usage, if your looking at artistic usage, you can control what and where the image is used. But if your doing stock or commercial photos, you have much less control over where they go.
Most models will be more than happy to get some small monies out of a shoot over and done with, The issue that you have to be careful of is making sure you can use the image. I do have images I didn't get a release from the model, and can no longer access the model, so I can't use the image. -

Wed, January 28, 2009 - 1:44 PMFeral were you registered media? if yes, BMorg suppose to get a cut, and it is on the Burningman.com website. If you were not but as personal use you must contact BMorg for the correct answer as far as selling BM related images.
Not all BM images will be hit record, nor will you make $$$$ of dough, in fact it this is the case, BMorg may even clamp down on your images.
I would start with local library or google model releases.
As far as model releases I would recommend reading everything out there on releases.

I've yet to navigate the jungle of the legal realm of photography and working with people. Perhaps I'll just take my best stab at modifying the release and see if she's happy with the language.
I agree that this arrangement is not ideal and not what I'd like to do in the future. It was an informal agreement to begin with and the model trusted me enough to accept that I'd share any profit. The trouble came in when I needed a release to sell over the internet through Deviant Art. They need a release, and she decided that if it was going to go to that kind of formality that she wanted to include our agreement in writing as well.
This has been a learning experience and I'll do things differently in the future for sure. Thanks for you advice. -

Sun, March 29, 2009 - 11:10 AMI suggest leaving it alone and setting yourself up correctly for the next time. I find it really hard to believe however that a festival that is prided on liberty and freedom would have an organization that they for some reason owned rights to someones images especially if they aren't in contract with them !? Sounds very strange to me and I would look further into that if I were you. By rights as the photos were taken in a public place as editorial they can be used without any release at all ( although I highly suggest releases as they respect the models rights ) however if you were to sell the image for editorial not commercial ie. a story written about BM then you are not entitled to have a release. Anyways all the copyright laws etc are very sticky so the best order of business is sign a contract prior to any shoot and by law you actually have to compensate the model for the contract to be binding. Payment cn be a dollar or a lunch or a rubber ducky but there must be an exchange.
There is sooo much involved in the implications of what you would like to settle that it may be easier to chalk it up as an experience for the both of you and leave it at that. -
